EU Law and Etihad: Why You Are Protected Even on a UAE Airline

Whether you flew – or were supposed to fly – from London (approx. 5,500 km), Frankfurt (approx. 4,860 km), Paris (approx. 5,250 km), Rome (approx. 4,440 km), or Amsterdam (approx. 5,190 km), the €600 bracket applies.

Three Situations That Give You the Right to Claim

Your flight arrived more than 3 hours late Compensation is measured at arrival, not departure. If Etihad’s doors opened at your destination more than three hours after schedule – and the cause was within the airline’s control – you have a valid claim.

Your flight was cancelled with less than 14 days’ notice A cancellation announced fewer than two weeks before departure entitles you to compensation plus a choice of a full refund or free rebooking. The closer to departure the cancellation came, the stronger your position.

You were denied boarding due to overbooking Like many airlines, Etihad may occasionally overbook flights. If you arrived on time with a confirmed ticket and were turned away involuntarily, EU law entitles you to compensation and immediate rebooking or a full refund.

Strike on Your Etihad Flight? Here Is Whether You Can Claim

Not all strikes are treated the same under EU law – and knowing the difference could be worth €600.

Etihad’s own staff on strike : Compensation likely applies If pilots, cabin crew, engineers, or other Etihad employees take industrial action, this falls within the airline’s operational responsibility. Passengers affected by a disruption caused by an internal Etihad strike may be entitled to full financial compensation under EU Regulation 261/2004.

Third-party strikes : Compensation may not apply Air traffic controller strikes, airport security walkouts, and action taken by baggage handlers employed by the airport – not by Etihad – are usually classified as extraordinary circumstances. In these situations, the financial compensation obligation may not apply.

What never goes away – the duty of care: Regardless of who is striking, Etihad must still provide meals, drinks, accommodation, and communication access during the disruption. If you were left without any support at the airport during a strike-related delay, that is a separate issue you can raise.

If Etihad has told you a strike was the reason for your disruption and denied your compensation claim, it is worth having that decision reviewed – airlines sometimes classify disruptions as extraordinary when they legally do not qualify.

Downgraded from Business Class? That Costs Etihad Money, Not You

Being moved from Etihad’s Business Studio or The Residence to a lower cabin without your consent is called an involuntary downgrade – and it entitles you to a partial refund of your ticket price.

EU Regulation 261/2004 sets fixed reimbursement rates:

  • Flights up to 1,500 km : 30% of the fare back
  • Intra-EU flights over 1,500 km and other flights between 1,500 km and 3,500 km : 50% back
  • Flights over 3,500 km : 75% back

Since every Etihad European route exceeds 3,500 km, the 75% rate applies across the board. On a premium long-haul business class fare, that is a meaningful amount – and Etihad cannot deduct any taxes or surcharges from this refund.

Technical Faults Are Etihad’s Problem – Not Yours

One of the most common ways airlines try to avoid compensation is by labelling technical issues as extraordinary circumstances. Under EU law, this rarely holds up.

Routine mechanical faults, aircraft system failures, and maintenance issues are part of normal airline operations. EU courts have consistently ruled that these do not qualify as extraordinary circumstances – meaning Etihad remains liable to compensate you even when a technical problem grounds or delays your flight.
